They were new, the buyer just didn't like the way the studio packaged them.

Amazon defines "new" condition for dvds and blu-rays in part as in being in "perfect" condition. Therefore, when you buy something off amazon, you enter into a contract for the sale of goods in perfect condition. If the packaging is damaged, then the product is not in perfect condition, even if it is a manufacturing defect. Amazon has promised to deliver an item in perfect condition, not an item in the condition it was when they took delivery from the manufacturer. When Amazon took delivery of the goods from Criterion, they had the chance to inspect the goods and did not reject the delivery even though they may have had a right to reject. When Amazon wrote into the terms of sale (a contract which will be strictly applied against them because they authored it) that "new" condition meant "perfect" condition, Amazon made a choice. When they delivered goods that were below the condition advertised they took a risk. They buyer could have accepted the goods or the buyer could have rejected the goods as not conforming to the contract. Here, the buyer rejected the goods. It is rude to make snarky comments at people who are exercising valid rights under the contract.

Just had the same problem with Shallow Grave, bought through Planet Axel (and already got it once on a Suzuki, if I recall correctly, but I managed that time to remove all plastic, not here). Fortunately, I have some spare cases from Criterion, so I was able to have a good looking one, but indeed, it is annoying. However, it is clearly not Axel's fault, nor it was Amazon's. It comes from whichever sub-contractor Criterion uses to flow wrap their products.

Pretty sure I've yet to see a DVD in 100.0000% perfect condition. Which is of course why I've never not returned anything I've ever ordered from Amazon.

If you think I am a lunatic, you should see what people sue each other for on a regular basis. It is a lot less than this. Maybe sit in on a real estate closing? People are completely insane and will demand outrageous things because they have you by the b---s. Regardless, when you have a contract for sale and cannot inspect the goods, you have the right to inspect them upon delivery and the seller has to give you the goods in the exact condition of the contract because you are buying them sight unseen. For example, just the other day I received Alambrista! from the Deep Discount sale and it had this exact problem. All I did was carefully peel the plastic off. I didn't even get annoyed. The only reason I responded is because you were snarky towards someone for exercising their rights under a contract. God forbid you are ever dissatisfied with something and have a right to do something about it.

I agree with TMDaines. In fact, the most numerous problems I have are with the MoC's booklets. Most of them are crushed on the back.

Clearly you guys need to have your microscopes calibrated. On a molecular level, there is surely at least one small thing wrong with every DVD you have ever purchased. Every diamond has its flaw, etc.
My personal threshhold for acceptable levels of damage is, I don't know, 98% perfect or thereabouts. I consider myself fairly picky.

I e-mailed Mulvaney and CCed [email protected] regarding getting replacement cases for the four titles I've received that've been sealed this way, and heard back from the orders e-mail within a couple of hours (they're sending me new cases). I urge anyone else having this issue with the way the titles are sealed to e-mail Claire (again, [email protected]) and explain why you're asking for replacement cases, and hopefully they'll start to take this issue into more serious consideration and begin sealing these the old way again.spocker wrote:The manufacturing plant seems to have hired crazy people to be in charge of the wrapping of the Criterion releases lately.

Harold and Maude and The Gold Rush arrived today with the plastic slightly melted to the spine also, so I do think their packaging facility has changed something. Criterion used to be one of the few distribs immune to this. The melted-on part did scratch off fairly easily though.
